United Kingdom - Copyright and Licensing
The following information provides a very brief overview of the copyright and licensing situation which is relevant to UK schools and churches who use Damaris resources.

Schools
The relevant legislation allows schools to use films and music for educational purposes without any special licence:
32.- (2) Copyright in a sound recording, film, broadcast or cable programme is not infringed by its being copied by making a film or film sound-track in the course of instruction, or of preparation for instruction, in the making of films or film sound-tracks, provided the copying is done by a person giving or receiving instruction.
34.-(1) The performance of a literary, dramatic or musical work before an audience consisting of teachers and pupils at an educational establishment and other persons directly connected with the activities of the establishment- (a) by a teacher or pupil in the course of the activities of the establishment, or (b) at the establishment by any person for the purposes of instruction, is not a public performance for the purposes of infringement of copyright.
34.-(2) The playing or showing of a sound recording, film, broadcast or cable programme before such an audience at an educational establishment for the purposes of instruction is not a playing or showing of the work in public for the purposes of infringement of copyright.

Churches who wish to use films and music are required to obtain the following licences - for these you should contact CCLI via their website or by phone (01323 436103):
Copyright Licensing for Films
The showing of a film clip or full feature outside of normal social and domestic use is a right restricted under UK copyright law. Films include a number of protected rights, including music and dramatical work performance, therefore showing film clips in churches or other church/ministry activities will require a Church Video Licence which affords the right to show films from authorised producers in church services or other church activities.

A film will also include 'Musical Works' and churches should be advised that the showing a film outside of an act of worship will require the additional cover of a PRS Church Licence (see below).
Music Performances and Concerts
The performance of music either live or from a commercial sound recording will require the cover of a Performing Right Society Church Licence. Premises deemed to be a 'concert venues' (5 or more live concerts in a 12 month period) or village/community projects may require direct licensing from the Performing Rights Society.
Playing Sound Recordings
The playing of a commercial sound recording (CD, DVD, cassette etc.) in a public place will, in addition to the Performing Right Society Church Licence (see above), require the cover of a Phonographic Performance Licence unless the church or organisation can prove that the organisation is not established or conducted for profit and its main objects are charitable or are otherwise concerned with the advancement of religion, education or social welfare.
